Terms of sale
The owner of the online store pooko.ee (hereinafter the Online Store) is Evolvum OÜ (16792457 ), located at Pihlaka tee 25, Rahula, Saku parish, Harjumaa 76414.
1. General conditions:
1.1. These terms and conditions of sale regulate the legal relations between the owner of the shopping environment ledex.ee (hereinafter referred to as Ledex e-shop) Evolvum OÜ (hereinafter referred to as the Seller) and persons who purchase products through the Ledex e-shop (hereinafter referred to as the Buyer).
1.2. In addition to these terms and conditions, the legal relationships arising from the purchase of products through the Ledex e-shop are governed by the legislation in force in the Republic of Estonia.
1.3. Ledex.ee reserves the right to unilaterally change and supplement these terms and conditions and the price list for the purpose of efficiency, competitiveness, future development and addition of the assortment of goods. Changes and additions to the conditions and price list take effect from the moment the mentioned information appears on the page www.ledex.ee . If the Customer submitted his order before the changes to the terms and conditions entered into force, the legal relations between the Customer and the Seller shall be governed by the terms and conditions valid at the time the order was submitted, unless otherwise provided by law or these terms and conditions.
2. Validity of the sales contract, product and price information
2.1. The terms of sale apply to the purchase of goods from the Online Store.
2.2. The prices of the products sold in the online store are indicated next to the products. The price includes a fee for delivering the goods. All prices of goods sold in the online store are in euros.
2.3. The fee for delivering the goods depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when completing the order.
2.4. Information about the product is provided in the Webshop directly next to the product.
2.5. All prices include VAT 22%.
3. Shopping basket and ordering
3.1. To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate method of product delivery. The amount of the fee is then displayed on the screen, which can be paid securely through the following payment methods:
- Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay, Citadele, Revolut, N26
- Pay later solutions: Inbank split into parts, Inbank pay next month
NB! When paying with a bank link, be sure to press the "Back to the merchant" button on the bank's page.
3.2 Payments are mediated Maksekeskus AS . Payment is made outside the Webshop in a secure environment - when paying with a bank link, in the secure environment of the respective bank, and in the secure environment of Maksekeskus AS when paying with a credit card. The seller does not have access to the customer's bank and credit card data. The contract enters into force from the receipt of the amount to be paid to the current account of the Online Store.
3.3 The owner of the online store is the responsible processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.
3.4 If the ordered goods cannot be delivered due to the end of the goods or for some other reason, the buyer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned without delay, but no later than within 14 days of sending the notice.
4. Payment
4.1. The order will be completed and delivered in case of 100% advance payment.
4.2. The customer, who selects the desired products, undertakes to enter the data required to complete the order (surname, first name, contact telephone number, e-mail address, delivery address, postal code, payment method).
4.3. The e-shop does not process bank payments itself. Payment is made in the secure environment of Maksekeskus (www.maksekeskus.ee). By submitting payment data or other data, you agree to the third party's terms of service and financial information.
4.4. After placing the order and payment, the order confirmation and invoice will be sent to the Customer by e-mail. By confirming the order, the Seller undertakes to hand over the ordered products to the Customer in accordance with these terms of use.
5. Delivery
5.1. The goods are sent to the following countries: all member states of the European Union.
5.1. The goods are sent within Estonia using parcel machine services provided by Omniva (AS Eesti Post) and Itella SmartPOST OÜ, as well as DPD parcel machines and courier services.
5.2. The shipping costs of the goods are borne by the buyer, and the corresponding price information is displayed next to the shipping method.
5.3. Orders placed in the online store are reviewed on the same day, and the buyer is contacted no later than the next business day.
5.4. Shipments within Estonia generally arrive at the destination specified by the buyer within 1-3 working days from the entry into force of the sales contract. If we are unable to deliver a product on the promised day, we will inform you immediately. If necessary, you have the option to cancel the order and we will return the money to you. Delivery outside of Estonia takes place according to the logistics company's delivery times.
5.5. Please ensure the correctness of the contact information provided when placing the order to avoid delays and misunderstandings in the delivery of the products. Evolvum OÜ and the courier company are not responsible for product delivery delays and misunderstandings if the delay or misunderstanding is due to the inaccuracy or incorrectness of the data provided by you when placing the order.
5.6 In exceptional cases, you have the right to deliver the goods within 45 calendar days.
6. Right of withdrawal, order cancellation and product return
6.1. After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. The 14-day right of withdrawal does not apply to goods that cannot be returned due to their nature (e.g. food, hygiene products).
6.2. The right of withdrawal does not apply if the buyer is a legal entity.
6.3. The goods to be returned must be unused, with tags and, if possible, in the original transport packaging. To familiarize yourself with the goods, it can be used in a way that is necessary to make sure of the nature, characteristics and functioning of the thing.
6.4. To return the goods, a free form application must be submitted to the e-mail address info@ledex.ee within 14 days of receiving the goods at the latest.
6.5. The cost of returning the goods is borne by the buyer, unless the reason for the return lies in the fact that the product to be returned does not correspond to the one ordered (e.g. a wrong or defective product).
6.6. The online store may refuse to issue refunds until it has received the item that is the subject of the contract or until the buyer has provided evidence that it has returned the item, whichever occurs first.
6.7. The money is transferred to the same settlement account on which it was received by the operator of the Webshop.
6.8. The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.
7. Legal act of submitting a claim
7.1. The claim period starts from the date of purchase of the goods.
7.2. The deadline for filing claims does not apply to goods whose defects result from improper use or normal wear and tear.
7.3. If the product does not meet the requirements or defects appear, please send a claim to the e-mail address info@ledex.ee , where the name of the orderer, contact telephone number, order number and a precise description of the product's non-compliance or defect are indicated.
7.4. Ledex is responsible for product compliance and defects in accordance with the Obligations Act. The time for submitting claims is 2 years for the consumer Buyer (private person) and 2 months for legal entities from the moment of handing over the products. In the case of a defect occurring within 1 year, it is assumed that it was present at the time of purchase of the product, and the nature of the defect must be determined by the seller. If the defect is of a technological nature, the Customer may demand that the product be repaired, and if the repair is impossible or ineffective, the product be replaced or the money refunded.
7.5. In the case of returning a product that does not meet the requirements, the Seller checks the justification of the claim and informs the Buyer of his answer within 15 days of receiving the claim.
8. Settlement of disputes
8.1. If the buyer has complaints about the Online Store, they must be sent by e-mail to info@ ledex.ee or by calling +372 56897905.
8.2. If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Committee. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the Online Store. You can familiarize yourself with the procedural conditions and submit an application at http://komisjon.ee . Review of the buyer's complaint by the commission is free of charge.
9. Force majeure
9.1. Ledex is responsible to the Buyer, and the Buyer is responsible to Ledex to the other party for direct property damage caused by violation of these terms and conditions in the cases and to the extent provided for in the legislation in force in the Republic of Estonia.
9.2. Ledex is not responsible for damages caused to you or delays in the delivery of the goods if the damage or delays in the delivery of the goods are due to circumstances that Ledex could not influence or foresee.
10. Personal data and their use
10.1. The online store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The online store transmits personal data to companies providing transport services in order to deliver goods.
10.2. The user gives clear and informed consent to the operator of the Webshop for the processing of his personal data.
10.3. The source of personal data is the creation of a customer relationship when registering an order in the online store.
10.4. The online store sends the buyer newsletters and offers to the buyer's e-mail address only if the buyer has expressed a desire to enter an e-mail address on the website and has indicated his wish to receive direct mail notifications.
10.5. The buyer can opt out of offers and newsletters sent to e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.
10.6. The operator of the online store undertakes not to forward registered personal data to third parties.
10.7. The operator of the online store reserves the right to transfer data concerning the user if they are transferred to a person who processes the data to fulfill obligations prescribed by law and has the legal right to do so, or if it is done to protect the life, health or freedom of another person of the Client.
10.8. The user gives consent to the administrator of the Webshop to send an order confirmation to the e-mail address entered when placing the order.
11. Terms of use
11.1. When submitting an order, by ticking "I agree to the terms of use of the online store and fulfill them unconditionally" in the corresponding window, the Customer agrees that he has familiarized himself with the terms of the User Agreement, understands them and accepts the terms of the User Agreement.
11.2. It is mandatory for the Customer to familiarize himself with the terms and conditions stated in the user agreement.
All product descriptions, photos and other data presented in the Ledex e-shop are protected by copyright and their copying or use in any other way without the consent of Evolvum OÜ is prohibited.
